Terms of Service

These Terms of Service ("Terms") govern your access to and use of JAMQpro — the web application at jamqpro.com and the JAMQpro iOS mobile application (collectively, the "Service") — operated by Jarratt VanDyke ("JAMQpro," "we," "us," or "our").
By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You may not create more than one account per person. You are responsible for all activity that occurs under your account.
2. Accounts
When you register, you must provide accurate, current, and complete information. You agree to keep your account information up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.
We may require email verification before you can access certain features. Accounts that remain unverified or inactive for extended periods may be removed.
3. Musician Conduct
As a musician using the Service, you agree to:
- Only sign up for queue slots you genuinely intend to fill.
- Cancel your slot in advance if you can no longer attend, giving other musicians a fair opportunity to take your place.
- Arrive and be ready to perform when called to the On Deck or Playing stage.
- Treat organizers, house band members, fellow musicians, and venue staff with respect.
- Provide accurate instrument and performance-type information when signing up.
No-shows: Repeatedly failing to show up for signed-up slots without cancelling may result in restrictions on your ability to sign up for future events.
4. Organizer Conduct
Creating venues and publishing events requires an active organizer subscription with a valid payment method on file. By signing up as an organizer, you agree to:
- Provide accurate information about yourself, your events, and your associated venues.
- Only create events at venues you are authorized to use.
- Manage your live queue in a fair and timely manner.
- Notify signed-up musicians promptly if an event is cancelled or significantly changed.
- Not misuse the platform to collect sign-up information for purposes unrelated to running jam nights or open mic events.
Organizer accounts are subject to a subscription fee after the free trial period. See Section 6 (Payments) for details.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Harass, threaten, or intimidate other users, organizers, or staff.
- Create fake accounts or impersonate another person or entity.
- Scrape, harvest, or collect data from the Service through automated means without our written permission.
- Attempt to gain unauthorized access to any part of the Service, its servers, or connected systems.
- Upload or transmit malware, viruses, or any harmful code.
- Post spam, unsolicited promotions, or off-topic content in any profile or notes fields.
- Interfere with or disrupt the Service or its infrastructure.
Violations may result in immediate account suspension or termination without notice.
6. Payments and Subscriptions
Musicians may use the Service free of charge.
Organizers receive a free trial period (currently 30 days from account activation). After the trial, continued access to organizer features requires an active paid subscription processed by a third-party payment processor.
Subscription fees are billed on a recurring basis (monthly or annually, as selected at sign-up). You authorize us to charge your payment method on file at the beginning of each billing period. Subscriptions automatically renew unless cancelled before the renewal date.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time except as required by applicable law.
Beta period: During the current beta period, billing may not be activated even after the trial period ends. We will notify you by email before any billing begins. Accounts designated as "billing exempt" by JAMQpro will not be charged.
We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers.
7. User Content
"User Content" means any information you submit to the Service, including your profile bio, instrument lists, social media links, event descriptions, notes on queue sign-ups, and organizer tipping links.
You retain ownership of your User Content. By submitting User Content, you grant JAMQpro a non-exclusive, royalty-free, worldwide license to store, display, and distribute that content as necessary to operate the Service (for example, showing your name and instrument to other users on the public queue).
You are solely responsible for your User Content. You represent that you have all necessary rights to submit the content and that it does not violate these Terms, any third-party rights, or applicable law.
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise objectionable.
8. Intellectual Property
The Service and its original content — including the JAMQpro name, logo, design, software, and text — are owned by Jarratt VanDyke and protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.
9. Third-Party Services
The Service integrates with third-party platforms including a third-party payment processor for organizer subscriptions, Gravatar (profile images), SendGrid (email), Twilio (SMS), Apple APNs (push notifications), and Railway (hosting). Your use of these services is subject to their respective terms of service and privacy policies. JAMQpro is not responsible for the practices of these third-party providers.
Organizer profiles may display voluntary tipping links (Venmo, PayPal, CashApp, Apple Pay). Any transactions made through those links are between you and the organizer directly. JAMQpro is not a party to those transactions and takes no responsibility for them.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and share your information.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
JAMQpro does not guarantee that any specific jam night, event, or venue listing is accurate, active, or will take place as described. We are a software platform that facilitates connections between musicians, organizers, and venues — we are not an event organizer or promoter.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JAMQPRO AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO JAMQPRO IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless JAMQpro and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
14. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason including — but not limited to — a violation of these Terms, extended inactivity, or conduct we determine to be harmful to the Service or its community.
You may close your account at any time by contacting [email protected]. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 11, 12, 13, 15, and 16) will survive.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Pierce County, Washington, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will update the "Last Updated" date above and, where required, notify you by email or in-app notice. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
